1. About Arokiyam

Arokiyam is operated by MARCHE HEALTHCARE PRIVATE LIMITED. We act as a Significant Data Fiduciary (if applicable) or Data Fiduciary under the Digital Personal Data Protection Act, 2023.

2. Eligibility and Age Verification

• Minors: If you are under 18 ("Child" as per Rule 10), you are strictly prohibited from creating an account without the Verifiable Consent of your parent or lawful guardian.
• Verification: We reserve the right to verify your age using mechanisms prescribed under the DPDP Rules, 2025 (such as tokenized verification or Digital Locker). Failure to provide proof of age/consent upon request will result in immediate account termination.

3. Bookings & Appointments

• You must attend appointments on time
• Token numbers and visit timings are calculated based on doctor capacity
• Repeated no-shows or late cancellations may result in account restrictions
• Emergency bookings receive priority but have additional platform and consultation fees

4. User Responsibilities & Data Accuracy

You agree to:

• Provide accurate, complete, and consistent personal data (Rule 14)
• Keep your contact information updated to facilitate necessary communications regarding data breaches or policy changes
• Not impersonate others, especially regarding age or guardianship status
• Attend scheduled appointments or cancel in advance
• Maintain respectful communication with doctors and staff
• Not use the app for medical emergencies (call 108 or visit emergency services instead)

5. Doctor Responsibilities

Doctors using Arokiyam agree to:

• Treat patient data accessible through the App as confidential and process it only for the purpose of healthcare delivery
• Comply with applicable medical retention laws
• Maintain accurate schedule and availability information
• Honor confirmed appointments except in unavoidable circumstances
• Respond to doubtful date bookings promptly
• Provide genuine medical information and services
• Be registered and licensed to practice medicine in India

6. Payments & Fees

• Consultation fees are paid directly to the doctor unless paid through the app
• Platform fees (if applicable) are paid through the app
• Emergency bookings have additional charges
• Payment methods accepted: UPI, cards, net banking, and other digital payment methods

8. Content & Videos

• Doctors may upload health-related videos (max 5 videos, 30 seconds each)
• All content must be appropriate, legal, and medically accurate
• We reserve the right to remove inappropriate content
• Videos and content are for informational purposes only, not medical advice
• You may not copy, distribute, or misuse platform content

9. Advertisements

Doctors can create image advertisements displayed to patients within a specific location radius. All ads must comply with Indian advertising regulations and medical ethics guidelines.

10. Privacy & Data Protection

Your use of the Platform is governed by our Privacy Policy, which is incorporated here by reference. You acknowledge that Arokiyam processes your data in accordance with the Digital Personal Data Protection Act, 2023 and Rules 2025. You consent to us contacting you via SMS/Email/WhatsApp for service delivery and legal intimations (e.g., Breach Notifications).

11. Consent Manager Interoperability

In the future, consistent with Rule 4 of the DPDP Rules, 2025, Arokiyam may enable interoperability with registered Consent Managers to allow you to manage your consent preferences through a centralized platform.

12. Limitations of Liability

Arokiyam is not liable for:

• Medical malpractice or outcomes of treatment
• Doctor cancellations, delays, or rescheduling
• Technical issues, app downtime, or network errors
• Incorrect information provided by users or doctors
• Unauthorized access due to user negligence

Our maximum liability is limited to the amount paid for the specific booking in dispute.

13. Account Termination

We may suspend or terminate accounts if:

• False age or identity information is provided
• Verifiable Parental Consent is found to be forged or invalid
• Platform policies are violated
• Fraudulent or abusive behavior is detected
• Repeated no-shows or misuse occurs

14. Changes to Terms

We may update these Terms to comply with the evolving Data Protection Board guidelines. We will notify you of significant changes via the App or Email.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of India.

• Data Protection Disputes: Complaints regarding personal data must first be addressed to our Grievance Officer. Unresolved data disputes may be escalated to the Data Protection Board of India.
• Other Disputes: Subject to the exclusive jurisdiction of the courts in Pondicherry and Tamil Nadu.

16. How Arokiyam Works

For Patients:

• Browse and search for doctors by specialty, location, and availability
• View doctor schedules showing available, doubtful, and unavailable dates
• Book appointments on available dates (confirmed immediately) or doubtful dates (requires doctor confirmation)
• Receive token numbers and estimated visit times based on the doctor's schedule
• Book for yourself or family members
• Access emergency booking with priority (additional charges apply)

For Doctors:

• Create schedules for different clinic/hospital locations
• Set availability status (available, doubtful, unavailable) for each date
• Create multiple sessions per location (e.g., morning and evening)
• Confirm or reschedule bookings for doubtful dates
• Upload up to 5 videos (maximum 30 seconds each)
• Create image advertisements visible to patients in your location
